Penalties for Lewd Conduct Offenses

The California penalties for offenses involving lewd and lascivious behavior vary depending on the charge. Listed below are the penalties for the most common lewd act charges. Those marked with an * asterisk require lifetime sex offender registration upon conviction.

Penal Code 647 Engaging in Lewd Conduct in Public
A conviction for Lewd Conduct under California Penal Code 647(a) or 647(d) carries a penalty of up to five (5) years of misdemeanor probation, up to one (1) year in the county jail, and a fine of up to $1000 plus court assessments.

*Penal Code 314 Indecent Exposure
A conviction for Indecent Exposure under California Penal Code 647(a) or 647(d) carries a penalty of up to five (5) years of misdemeanor probation, up to one (1) year in the county jail, and a fine of up to $1000 plus court assessments. A subsequent Offense can be charged as a felony.

*Penal Code 288 (a) Lewd or Lascivious Acts Involving Children
If a person is convicted of Lewd Acts on a Child Under 14, and probation is granted, the penalty is up to five (5) years felony probation and up to one (1) year of county jail. If probation is denied, the penalty is up to eight (8) years in California state prison.

*Penal Code 288 (c)(1) Lewd or Lascivious Act on a Minor 14 or 15 Years Old
This section applies when the lewd act is upon a minor 14 or 15 years old, and the defendant is at least 10 years older than the minor. If probation is granted, the penalty is up to five (5) years felony probation and up to one (1) year of county jail. If probation is denied, the penalty is up to three (3) years in California state prison.

*Penal Code 288.5 Continuous Sexual Abuse
This section is charged when the defendant resides with a child under 14, or has recurring access to the child, and engages in three or more lewd acts with the child over a period of three months or more. Upon conviction, the penalty is up to 16 years California state
