Lewd Conduct Penalties

The penalties for misdemeanor lewd conduct in California can include probation, fines, counseling and jail time. The penalties for felony lewd or lascivious acts or behavior can include California state prison and registration as a sex offender.

In either case, a lewd act conviction will go on one's permanent criminal records and probably appear on any background check conducted by potential employers or licensing agencies. It is imperative, therefore, to fight the lewd conduct charges and avoid a conviction!

Definition of Lewd Conduct

The definition of lewd conduct varies depending on the particular offense charged. Generally, however, a lewd act is defined as the touching of the genitals, buttocks or female breasts with the intent of achieving sexual arousal or gratification.

These sorts of sexual acts are obviously not inherently illegal. They become what the law defines as "lewd or lascivious," and therefore illegal, in certain situations:

(1) when done in pubic and in the presence of
a third party who might be offended (Penal Code
647 Lewd Conduct); or

(2) when performed on or with a minor or child
(Penal Code 288 Lewd Acts).
